Disclosures for a local Council election group of candidates

Political donations and electoral expenditure must be disclosed to the NSWEC after each financial year.

A declaration of disclosures must be made using a NSWEC disclosure form for the relevant year (See Forms).

Follow the steps below to lodge a valid disclosure form or learn more about how to disclose.

Five steps to lodging a valid disclosure form

If two or more people did any of the following between 1 July 2016 and 30 June 2017 a disclosure form must be submitted by 22 September 2017:

  • was registered as a group of candidates with the NSWEC for a local Council election,
  • was nominated as a group of candidates for a local Council election,
  • accepted a political donation or made a payment for electoral expenditure in relation to the group's candidacy at a future local Council election.

If you are a candidate who is a member of a group, and your official agent is the same person who is the official agent for the group, the official agent is responsible for submitting the disclosure form for the group of candidates, and for each candidate who is a member of the group, who has appointed him/her as their official agent.

If you are a candidate who is a member of a group, and your official agent is not the same person as the official agent for the group, your official agent is responsible for using the disclosure form for a local Council election candidate.

The person who is the official agent for the group of candidates is responsible for completing and submitting the disclosure form.

The official agent is to refer to the financial and accounting records kept in relation to the group of candidates in order to make complete and accurate disclosure.

The disclosure form must be certified by a registered company auditor if any of the following apply:

  • the total political donations received by the group of candidates and each candidate in the group (with the same official agent) exceeds $5,000,
  • the total electoral expenditure incurred by the group candidates and each candidate in the group (with the same official agent) exceeds $5,000,
  • reportable political donations were made that were not in the form of affiliation of membership fees to a party by which the candidate is a member, or to a group of which the candidate is a member.

A valid disclosure form must be lodged with the NSWEC by 22 September of each year. Details about how to submit the disclosure form are on page 11 of the form. A valid disclosure form is one that:

  • contains all of the pages (even if some pages contain no disclosures),
  • is completed and signed by the official agent, and
  • is certified by a registered company auditor (if required).

Submit with the disclosure form:

  • the receipt book containing used and unused copies of receipts issued to political donors for all reportable political donations received,
  • copies of the invoices or receipts for electoral expenditure disclosed in Part F of the form,
  • copies of the electoral material or advertising that relates to the expenditure disclosed in Part F of the form.
